How to prove Florida residency for tax purposes
Updated . Not tax or legal advice.
To prove Florida residency to New York you need two kinds of proof: records that show your life moved to Florida, and a record of where you were on every day. Paperwork such as a Florida driver license helps, but on its own it carries little weight in an audit.
1. Records that show Florida is home
| Record | When | Source |
|---|---|---|
| Florida auto insurance | Within 10 days of becoming a resident | FLHSMV |
| Florida driver license | Within 30 days | FLHSMV |
| Car title and registration | After Florida insurance | FLHSMV |
| Voter registration | Soon after the move | FL Division of Elections |
| Declaration of Domicile | Any time | Fla. Stat. §222.17 |
| Homestead exemption | Live there Jan 1, apply by Mar 1 | PBCPAO |

2. Proof that your life moved
New York compares five things: your homes, your business role, your time, where you keep near and dear items, and where your family lives. Moving these is the evidence that counts most. Hodgson Russ Read the two New York tests for what auditors compare.
3. A record of every day
Auditors ask where you were on each day, and days you cannot prove count as New York days. Phone records are now the most important source; card statements, EZ-Pass, boarding passes and hotel bills support them. Hodgson Russ Keep these as you go, not years later. The 183-day calculator shows how many New York days you have.
What does not work on its own
- A Florida driver license, voter card or Declaration of Domicile without the life changes behind them. McLaughlin & Stern
- A diary written after the fact with no third-party records behind it.
- Keeping a New York home furnished and ready while you spend 184 or more days in New York.
Questions people ask
What is the strongest proof of Florida residency for taxes?
No single record is enough. The strongest case combines official Florida records, real changes in where you live, work and keep your family and valued items, and day-by-day records that show you spent most of your time outside New York. Hodgson Russ
Who has to prove the move, me or New York?
You do. A person who says they changed domicile from New York must prove it by clear and convincing evidence. McLaughlin & Stern
